TERMS OF SALES
ARTICLE 1 : COMMITMENTS OF THE COMPANY
Any order placed with the company Ms Prestige entails the acceptance of all the conditions of sale (below), which form an integral part of the transport contract signed between the company MS Prestige and its principal. Any modification proposed by one of the parties may be accepted after written agreement by both parties.
The company MS Prestige undertakes to respect the times and places of care that were agreed upon when booking.
ARTICLE 2 : RATES
Our prices are all inclusive, fixed, expressed in Euro and known in advance, they cannot be modified due to road traffic.
The prices indicated include the vehicle, the driver’s service, insurance for transported persons, fuel, as well as tolls and parking lots.
“Entrances to the various sites, restaurants and all additional services remain the responsibility of the customer.”
The communicated price corresponds to a price on the basis of a classic transfer and according to the range of the vehicle, whatever the number of people. The quantity of baggage transported is limited to one suitcase and one hand baggage per person and must be the subject of prior information to the client to the company MS prestige beyond this quantity a supplement will then be invoiced according to the additional baggage.
For a provision service, an approach package will be calculated and the start of the service will take effect at the time and place agreed between the two parties. The carrier is in on way responsible for damages caused by the density of road traffic. This article is also valid for wedding packages and other events…
For specific requests, please tell us in your message, the price will be offered based on the items you have sent us.
Our prices are understood to be 10% VAT for passenger transport service and 20% for provision of services.
ARTICLE 3 : RESERVATIONS
For all reservations, we will send you a quote corresponding to the elements provided. This estimate must come back to us, by post or electronic means, dated, signed and must contain the mention “Good for agreement for execution of the transport or the service”.
The firm reservation of the vehicle will only be taken into account upon receipt of said quote and deposit in the amount of 30% indicated on the quote. The balance of the quote must be paid in full taking charge of the customers.
Invoices will be sent to you by email or post after services.
ARTICLE 4 : PAYMENT
We accept the following payment methods : Cash, Visa, Master Card, American Express, Bank Transfer, Online to a secure link, Foreign currency *

ARTICLE 5 : MODIFICATION DURING SERVICE
The Vehicle is rented for a well-defined service, it will be imperative to notify the MS Prestige Company as soon as possible, of any change in order to best prepare the transport and ensure the smooth running of the service.
Any modification of the journey by the customer during the service may generate additional costs to be paid directly to the driver or reimbursed directly to the company MS Prestige at the end of the service.
In the event of a change in the route or its duration due to the client, the driver will note them on his mission order and have them signed by the client.
In the event of a modification of the duration due to the sole initiative of the principale, the costs incurred will be borne by the latter.
Last minute changes could e called into question if they disrupted the daily organization of the MS Prestige Company or its driver, in which case no modification may be made without the agreement of the management of the MS Prestige company
ARTICLE 6 : DRIVER OBLIGATIONS
The driver has the obligation to have a respectable dress imposed by the company MS Prestige, to offer a clean vehicle and must respect the rules of security, respect, confidentiality and punctuality.
In the event of a delay or a problem occuring during his approach to the place of care or during the service, the driver must notify his client and MS Prestige as possible.
ARTICLE 7 : CUSTOMER OBLIGATIONS
All vehicles are non-smoking, the driver can take breaks at the request of the customer.
We require respect for the equipment, any damage to the interior or exterior equipment of the vehicles will be invoiced.
Wearing a seat belt is compuisory. It is forbidden to leave your head outside or open and close the doors without the driver’s authorization. The driver reserves the right to lock the windows, the trunk and the doors.
Baggage or any other object owned by the customer remains under his responsibility. The MS Prestige Company cannot be held responsible in the event of theft of valuables and luggage left in the vehicle.
For reasons of safety and respect for the vehicle, only the driver is able to open and close the doors.
The customer undertakes: to maintain a correct attitude, not to consume narcotics, not to get drunk.
The client undertakes to respect the meeting times agreed between the two parties. An increase in the price offered may be applied in the event of non-compliance with these.
Animals on board vehicles can be authorized in agreement with the company and in compliance with the highway code.
An accepted animal takes the place of a person. The MS Prestige company reserves the right and authorizes its drivers to refuse access to the vehicle in the event of non-compliance and an excess number of passengers.
ARTICLE 8 : REGULATIONS / ROAD CODE
The vehicle and the driver will be provided with the vehicle documents necessary for the smooth running of the entire service. The ordering party and passengers are required to comply with the regulations applicable to persons and their luggage in the country crossed.
The driver must respect the road regulations in force. In no case may the customer demand that the driver exceed the authorized speed limit or commit traffic violations.
The driver reserves the right to interrupt the current service if the behavior of customers or their immediate entourage jeopardizes the safety of the driver or the vehicle, if they commit an offense, or if they behave in an insulting manner-to the driver. No refund can then be required.
ARTICLE 9 : WAITING TIME OF THE DRIVER
In the event of a customer delay and depending on the availability of our schedule, the driver remains in place and waits under the following conditions:
Arrival on a conventional flight: The driver waits up to an hour at no additional cost* Beyond the first hour, this hour becomes chargeable, ie € 50/h and any additional half hour waiting started is due at the price of € 25 / half hour.
Arrival by train : The driver waits up to 30 minutes at no additional cost * Beyond 30 minutes, this first half hour becomes chargeable, ie 25€/half hour and any additional half hour started is due.
Pick-up from a hotel or any address defined by the client: The driver waits up to 15 minutes at no addtional cost * Beyond 15 minutes, the first quarter hour becomes chargeable, i.e. €15/quarter hour and any additional quarter hour started is due.
This rate is applicable for conventional transport.
In the event that the driver cannot remain on site in order not to compromise the planning of his day, the company MS prestige will do everything in its power to transport another vehicle as soon as possible. Under these conditions, waiting for customers may be necessary and incurring additional costs for it.
The waiting conditions for a private flight arrival or for a particular event will be described in the offer when the quote is proposed.
*The time taken into account is that of arrival initially planned by the railways, airlines or that of the customer defined when booking.
ARTICLE 10 : WITHDRAWAL / CANCELLATION
Any reservation canceled within 3 days (72 hours) preceding the pick-up time as defined in the quote accepted by the client, will be invoiced at a rate of 50% of the amount the quote.
Any reservation canceled within 24 hours preceding the pick-up time as defined by the quote accepted by the client, will be billed at the rate of 100% of the amount of the quote. The non-presentation of the persons to be transported to the meeting (address and time) of support fixed by the client cannot constitute a case of cancellation of the contract giving entitlement to payment of the service provided and damages or disbursements suffered/incurred by the company.
MS Prestige reserves the right to cancel the service until the day of departure in the event of force majeure-the deposit being returned.
In the event that we cannot make the vehicle provided for in the initial contract available, the deposit will be fully refunded, unless the two parties agree on the provision of another vehicle.
In the event of a breakdown during the service rendering the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.
We reserve the right to cancel the service in the event of force majeure if the weather conditions may jeopardize passenger safety.
ARTICLE 11 : LIMITATION OF LIABILITY AND DISPUTES
The company MS Prestige can in no case be held responsible for delays in transport times due to circumstances beyond its control : road blocked, road structure prohibited to traffic, detour, flooded road, snow, traffic jams, interventions on the pavement of plublic forces (police, customs, firefighters, etc…).
In case of immobilization of the vehicle during the journey due to a mechanical failure, an accident or damage (degradation, theft), the company MS Prestige will endeavor to ensure the continuity of the route, either with one of its vehicles, or with a vehicle chartered to another company and undertakes to notify the client.
If the company MS Prestige does not find any solution for the replacement of the vehicle during the service making the vehicle unavailable, the amount of the service will be calculated in proportion to the time spent, without recourse or compensation for the damage caused.
In the event of a dispute, only the Commercial Court of ANNECY will be competent.
Any complaint is admissible only within 8 days after the end of the execution of the transport service concerned.
The company MS Prestige reserves the right to use for promotional purposes the photographs taken during the services.
